Marissa Alexander Denied "Stand Your Ground" Hearing


July 22, 2014 | WMFE, Orlando - Marissa Alexander cannot use Florida's "stand your ground" law as protection against attempted murder charges, according to a new ruling. A judge has rejected the Jacksonville woman's argument that a revision to the law, inspired in part by her case, should grant her immunity from prosecution.

This will be Marissa Alexander's second trial, and Friday's new ruling marks the second time a judge has denied her request to invoke Florida’s "stand your ground" law.

Alexander's attorneys argued that a new revision to "stand your ground" signed into law in June allows warning shots.

But Circuit Judge James H. Daniel ruled that the revision "cannot be applied retroactively."

Alexander says she fired a warning shot near her abusive husband after he threatened to kill her. Her conviction and twenty-year sentence after the first trial in 2012 were overturned on appeal, and a new trial date has been set for December 1st.

Lawmakers have said the "warning shot" revision was inspired in part by Alexander’s case.
