Federal Judge Rules FL Drug Testing Law Unconstitutional

January 1st, 2014 | WMFE - A federal judge has struck down a Florida law requiring applicants for welfare benefits to undergo mandatory drug testing.

US District Judge Mary Scriven ruled Tuesday that the law was unconstitutional and should not be enforced. The ruling made permanent an earlier, temporary injunction Scriven previously issued to bar the law from taking effect.

Governor Rick Scott was a supporter of drug testing for prospective welfare recipients, saying it helped protect taxpayers and families.

Opponents of the law argue it amounted to unconstitutional search and seizure.
